Terms of Service

These Terms of Service ("Terms") govern your use of the biobit.me website and automated messaging services operated by Biobit Technologies, Inc. ("Biobit", "we", "us"), including SMS and MMS sent through Twilio on behalf of our clients and their end customers.

Website use

This website is provided for informational purposes about Biobit's software development services. You may not use the site for unlawful purposes, attempt to disrupt its operation, or scrape content without permission.

SMS and automated messaging terms

By opting in to receive text messages from a service powered by Biobit, you agree to receive automated SMS or MMS messages related to that service. Messages are sent for operational and service-related purposes only — such as dispatch updates, confirmations, reminders, and account notifications — and not for unsolicited marketing unless you have separately opted in to marketing messages where permitted by law.

Consent required. We send automated text messages only to recipients who have provided prior express consent. You represent that any mobile number you provide is yours and that you are authorized to receive messages at that number.

Opt-in only; no purchased lists. Messages are sent only to opted-in customers, users, and personnel with a legitimate service relationship. We do not send messages to numbers obtained from third-party lists or without documented consent.

Internal and operational use. Messaging systems we build and operate are intended for internal business operations, service delivery, and customer-requested communications. Use for spam, phishing, illegal content, or purposes outside the scope of the subscribed service is prohibited.

Message frequency. Message frequency varies by service and account activity. Operational messages are sent only as needed to fulfill a request, complete a transaction, or deliver service-related updates you have opted into.

Charges. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opt-out. You may cancel text messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation and no further automated messages unless required by law. For help, reply HELP or email jack@biobit.me.

Privacy. We do not sell or share your mobile phone number with third parties for their marketing purposes. See our Privacy Policy for details on how mobile numbers and message data are handled, including our non-sharing commitment.

Compliance. You agree not to use our messaging services in violation of applicable law, including the TCPA where applicable, Twilio's Acceptable Use Policy and Messaging Policy, carrier rules, or A2P 10DLC and toll-free verification requirements. Clients using software we build are responsible for obtaining and documenting valid consent from their end users.

No client relationship

Visiting this website or booking an introductory call does not create a client, contractor, or partnership relationship. Any development work is governed by a separate written agreement signed by both parties.

Intellectual property

Content on this website — including text, design, and branding — is owned by Biobit or its licensors. Project names and logos displayed on this site belong to their respective products. You may not reproduce site content without written permission.

This site links to third-party products and services. We are not responsible for the content or practices of external sites.

Disclaimer

This website and its content are provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error-free operation, or delivery of every text message.

Limitation of liability

To the fullest extent permitted by law, Biobit shall not be liable for any indirect, incidental, or consequential damages arising from your use of this website or messaging services, including message delays or failures caused by carriers or third-party platforms.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Changes

We may update these Terms from time to time. Continued use of the site or messaging services after changes constitutes acceptance of the revised Terms.
